quick update:
I heard back from CDFW, who referred the matter to ~20 staff, who knew nothing about the gate; and told to report to CalTip, which I did today.
I got a private message on this form from State Lands Commission (from a staff person who works there and fly fishes), that my inquiry was received.
This is very unfortunate and inexcusably unexplained. I am rather bewildered, astonished, but mostly disappointed, that this would be done without any consideration of the Public which has been using this access to a navigable water for decades.
And, I also emailed Jon Messick to determine if the Yuba County Board of Supervisors had anything to do with this; per Kondo's post earlier here, I couldn't tell; and have been unable to find any record pertaining to this access location (north side of hwy 20 crossing).
Seems that NO ONE knows who did this then a visit with a sawzall or a torch set to remove it wouldn’t be illegal. I’m sure we will find out pretty quick who put it up after it’s been removed.
Thank you guys for being diligent on this, it continues to amaze me how so many government people, who should be aware of this, know nothing. There is a truth somewhere amongst all of this disinformation. My firm belief is that they just play dumb and figure we will go away over time. At the very least, the Yuba Country sheriff’s are very aware of this, as is the Yuba County Public works and possibly some people from Yuba County Board of Supervisors.
As I posted earlier, the gate on the south side of the river should be unlocked and open at this point. The 18 month time limit on that road closure has expired!
So I found some information on the Yuba County Board website at least for the gate on the Hammonton Road One the person that wanted the gate is Mike Lee with the Yuba County Community Development and Services Agency. Yubaman Bob is right the Resolution was for 18 months and the resolution was executed around 7/25/23. That Gate was paid for by Teichert a gravel company. It was closed due to all the 4 WD vehicles tearing up the south side of the Yuba on a mix of Public and Private property. It should be opened and everyone should call Mike Lee at the County. Not sure about the upper gate, but the quarry may have paid for the gate. It doesn't seem legal, but I bet Mike Lee knows something about this as well.
The letter also says they can extend resolution if no one protests so call or email. I can't find a board agenda but the board is definitely not notifying fishing groups. Here is some contact information for the Agency.

Not really an issue. Cal Fire would be through that gate in about 15 seconds if they needed to get in there. Everyone needs to contact this Lees dude asap though.
Do you think we have claim to a prescriptive easement? For both the new north side gate and Hamondton Smartville road closure ? It seems to me ( a layperson ) all the elements for prescriptive easement are in place. Must this easement be established in court, or does it already exist based merely on fact ? Could one use that as a defense against a trespassing suit ( either civil or criminal)?

I believe it is entirely on an already existing, Public easement, consisting of a Public road (Old HWY 20, now known as Parks Bar Road) and the easement purchased by the State (CalTrans) to build the new HWY 20 bridge. The gate is likely illegal. Yuba County Supervisor Messick has not responded to my inquiry.
IOW, an express easement. I am seeking verification by State Lands Commission on this
I spoke to Mike Lee today and he said the board extended the resolution for another 18 months three weeks ago. He said our only option would be to talk to the County board. I think we should at least attend the next meeting. They have a Zoom option to attend

Interesting, and I am sure he is correct. I guess, my question is, why is that not shown in any of the meeting minutes? He probably has no answer to that one. . .
I also notice from the initial closure, that the gate and road would be opened when “certain measures have been met”. . . WTF is that, talk about vague. The vote was 4-1 to approve closure, Supervisor Fuhrer being the only No vote. Maybe he is a person with a different viewpoint on this.
The long and short at this point, is that the Yuba County Sheriff, Dept. of Fish and Wildlife and Cal Fire have all weighed in on the closure. This has been a pain in the butt for Yuba County and they do not want to deal with it. It is an uphill swim, but not an impossible one, at this point. Cal Trout and others could be a player in this fight?

Hi all this is my first post on this site . I’ve been planning on drifting this river section for awhile and seeing there is no way to get to the water is very disappointing. Reading these post and looking on line for answers, it really sounds like this is being done in the interest of the private fish clubs. I bet these board members are apart of the clubs or know someone who is . The actions closing the roads turns the entire section into a private club . I may be completely wrong and hate coming into the group with this opinion but it feels to fishy not to think this way .
Hope to meet some of you on the river and maybe find a partner that can row and or at least attempt I and drift some water with me , Julian
Wow! I mentioned to a friend I was thinking I'd run up to the Yuba and see if any fish were rising to Skwalas. He recommended I look into access issues first. I had no idea this was going on. Thank you all, particularly amoeba and yubaman for trying to chase it down. It goes against what I'd always heard, that the public had access to navigable waters of California. And an easement to access below the high water mark on private property.
Has jmac, the attorney who offered to help on this, been able to start an action? Has the media been alerted? This does seem like the bureaucracies are stonewalling the fishermen.
In the mean time- where can I enter the Yuba to fish?

You can enter either at Hammond Grove Park or Sycamore Ranch and with a little hoofing, get to plenty of decent water. However, the flows are over 8,000 cfs at the moment making the river un-fish able. If you tried to wade, you’d be in big trouble.

I had a conversation with the manager of the Yuba Angler's Club which owns a mile and a half of shoreline property
on the north side of the river upstream from the bridge and he sent me a complete explanation of the location of public and private

Interesting, from what it would appear, they might have a lease on the property that was formerly accessible by the public on Parks Bar Road, and all the way up to end of the quarry. Much of that would be public property, as it would be below the 100 year median high water mark for much of the year. The current problem is that landowners are saying that there is no public access to that land. Depends on the Hwy. 20 easement issue.

I believe it's access through someone's property to the river. Though I'm not exactly sure where it specifically is, I think it's the same location Ron Speroni used to launch from decades ago when there were only a handful of guides drifting the river. I remember the days when the only guides you ever regularly saw with clients on the river were Speroni, Bill Lowe, Mike Bias, Popeye, Perry.......
I got a text from a random number today about this thread, and I couldn't be more grateful the work you have put in, Amoeba.
I agree that this is a transparency issue and something feels very off, my research also showed the Hwy easement existing and the gate placed on a public road with no notification or indication that it was put up by the County.
The best course of action would probably be to attend the County Board Meetings (https://agendasuite.org/iip/yuba) and get a 501c3 group involved.

There's no lease possible of a County Road. There is a permanent lease of the land under the new bridge below OHW, conveyed to the State (CalTrans) by the State Lands Commission (SLC). The rerouting of HWY 20 occupies another 35 acre lease from SLC. There is a split a few 100 feet from old HWY 20 that goes under the bridge that is only Parks Bar Road and I'm not certain, but, I believe that is also County Land, NOT Nordic or other private property. It actually may be within OHW, and the SLC lease. However, even if it is, the SLC cannot enforce the gate blocking access because it is not immediately adjacent to the lease. Enforcement of the blocking of legal access, under other laws like CDFW code 2008, would have to be done by others such as CDFW itself or the County. CDFW has yet to respond to my Clips complaint, and the County has been uncooperative at all levels.

Great in depth information here. This seems to continue down the path of stonewalling outside influence from the “Old Boys” local political network. I am convinced that local landowners and agencies were fed up in dealing with the elements hanging around these areas of the river, and have just gone ahead solved it in the quickest manner possible. The stonewalling and lack of response to your inquiries validates this to me anyways. Very interesting how things operate. Again, some people know much more than they are letting out or revealing on this matter.
Sounds like a pair of bolt cutters will solve this problem and when you inevitably get a trespass charge, you can bring it up to the judge. Unfortunately, it sounds like the county doesn't want to bother and a little malicious compliance will go a long ways here.

Nope, never responded...neither did board of supervisors...nothing from the guy who claimed he would help legal. Fuck Yuba River. Don't fish there, don't guide there and, especially, don't hire guides that pay these asshole Yuba Anglers for access. Screw the sheriff, CDFG, Nordic, Yuba County, and UC Sierra. Any of them could have fixed this access issue decades ago and instead they continue to be selfish fucks.
